The agreement
Terms of Service
- Version
- 2026-04-01
- Effective
- April 1, 2026
These terms are a contract between you and TruckApply. They cover truckapply.com and everything we do with the preferences you save with us. Read section 18 closely — it requires most disputes to go to individual arbitration instead of court, and it gives you 30 days to opt out of that if you'd rather not.
The short version: we're a matching service. You tell us what kind of driving job you want. We interview you, and we get paid by trucking companies when we introduce them to drivers who fit what they're hiring for. You never pay us. We are not your employer, we are not a staffing agency, and we do not run background checks on you.
1.Who we are
truckapply.com is operated by TruckApply (“TruckApply,” “we,” “us,” or “our”). We operate only in the United States and only serve people located in the United States.
You can reach us at contact@truckapply.com or (708) 852-3088.
By using this site or submitting the form, you agree to these terms and to our Privacy Policy, which is part of this agreement. If you don't agree, don't use the site.
2.What TruckApply is — and is not
What we are. A matching and referral service. You save your job preferences. We usually call you to go over them. We then introduce you to motor carriers whose openings line up with what you asked for, and those carriers pay us a fee for the introduction.
What we are not. Being precise about this matters, because these are all different legal things:
- Not an employer. We never employ drivers, we don't hire, and we don't make hiring decisions. Nothing here creates an employment relationship between you and us.
- Not a staffing agency, and not a driver-leasing company. We don't place you on assignment, we don't dispatch you, and we don't lease you to anyone.
- Not a consumer reporting agency, and not a background-check company. We do not pull your Motor Vehicle Record, we do not query the FMCSA Drug and Alcohol Clearinghouse, we do not run drug tests, we do not contact your previous employers, and we do not verify anything you tell us. See section 9.
- Not a CDL school, and not a training program. We don't sell training and we don't take a cut of tuition.
- Not an employment application. Our form is not the driver's application for employment that a motor carrier is required to collect under federal regulations. If a carrier hires you, they will have their own application, and you will have to fill it out.
3.Who can use this
To submit the form you confirm that all of the following are true:
- You are at least 18 years old.
- You are located in the United States, and you're looking for driving work in the United States.
- The phone number you give us is a number you actually control — it's yours, not a friend's, not a former number, and not a workplace line somebody else answers.
- You are giving us your own information about yourself, not somebody else's.
A note on age and interstate driving: federal rules generally require a driver to be 21 to operate a commercial motor vehicle in interstate commerce, though 18-to-20-year-olds can drive intrastate in most states and can participate in a federal apprenticeship program. We don't enforce those rules — carriers do — but if you're under 21, expect most of the openings we see to be out of reach for now.
We don't knowingly collect information from anyone under 18. If you believe someone under 18 submitted the form, email us and we'll delete it.
4.Free for drivers, always
You will never pay us anything. We do not charge drivers, we do not take a percentage of your pay, we do not charge for “placement,” and we do not ask for a deposit, an application fee, or a training payment. We do not collect payment card or bank information from drivers.
5.What you're telling us when you submit
When you submit the form, you're telling us that:
- The information is accurate and complete as far as you know. You can correct it any time by contacting us.
- You understand we will share it with motor carriers, and that we are paid for those introductions.
- You have the authority to give us the phone number you entered, and you agree to tell us if you give up that number.
- You're not using the form to advertise, to harvest data, or to test our systems.
You keep whatever rights you have in your own information. You give us a license to use, store, reproduce, adapt, and disclose it for the purposes described in these terms and in the Privacy Policy. That license ends when we delete your information, except for records we're required or permitted to keep — described in the Privacy Policy.
Don't put things in the free-text boxes that don't belong there. The “anything else” and “what happened” fields go to carriers after we review and scrub them. Don't type your Social Security number, a bank account, or a medical diagnosis into them. We filter what we can catch, but the reliable way to keep something private is not to type it.
7.Calls, texts, and how to stop them
When you check the contact box on the form, you're agreeing that we and the carriers we match you with may call and text you about driving jobs at the number you gave us, including for marketing purposes.
We dial by hand. TruckApply does not use auto-dialers or robocalls. The carriers we introduce you to are separate companies running their own phone systems, and some of them do use automatic dialing equipment or prerecorded messages — which is why the box you checked covers it.
- Message and data rates may apply. Message frequency varies.
- To stop texts: reply STOP to any text from us.
- To stop calls: tell whoever is on the phone, or email contact@truckapply.com, or reply to any text.
- Any reasonable method works. You do not have to use magic words or a particular channel. If you tell us to stop in a way a reasonable person would understand as “stop,” that counts, and we'll treat it as covering calls and texts about jobs.
We put you on our internal do-not-call list as soon as we can and no later than 10 business days after you ask. We keep you on that list indefinitely. To do that we have to keep enough information to recognize your number — that's the one thing a deletion request doesn't erase, because forgetting your number is how we'd end up calling you again.
Carriers are separate. Once we've released your details to a carrier, that carrier is contacting you on its own behalf under its own obligations. Telling us to stop does not automatically stop them, so tell them too. We'll pass along your request to carriers who already have your information, and we require them by contract to honor it, but we can't reach into their phone system.
8.The phone interview
That write-up is a real part of what a carrier is paying for — it's how they see what you're actually looking for in your own words instead of a set of checkboxes. It is limited to what you told us. It does not contain our opinion of you, and our own notes about a driver are never shared with any carrier.
Before a carrier sees the write-up, a person reads it and removes contact details and anything that doesn't belong. If you think something in it is wrong, email contact@truckapply.com and we'll correct it — you can also ask for a copy of it.
Our interviewer works from a script and won't ask you about your age, your family, your health, where you're from, your religion, arrests, or what you used to be paid. If someone calling in our name asks any of that, tell us.
9.This is not a background check
This section matters to you, so it's in plain language.
Everything a carrier sees about you came from you — from the form you filled out and the interview you gave us. We don't investigate you. We don't pull records. We don't verify your answers, and we don't grade you.
Practically, this means two things for you. First, if you told us something inaccurate, fix it with us — email contact@truckapply.com and we'll correct it. Second, if a carrier turns you down, that decision is theirs and is based on their own screening; we aren't the file it came from, and we don't have a copy of it.
10.No job guarantee, no pay promises
We do not guarantee that you will be contacted, interviewed, offered a job, or hired. We don't guarantee how many carriers will see you, or how fast, or that any of them will be hiring by the time they call.
Any pay figure you see anywhere on this site or hear from us is what a carrier told us they are offering, or a general range from the market. It is not an offer, it is not a promise, and it is not a representation about what you personally will earn. Actual pay depends on the carrier, the lane, the freight, your experience, and how much you run. Only the carrier can make you a pay offer, and only in writing from them does it mean anything.
The minimum pay you enter on the form is your stated preference. We use it to match. It does not obligate any carrier to meet it, and we may show you to carriers offering less if the rest of the fit is strong — you're free to say no.
11.Carriers are not us
Motor carriers are independent third parties. We check that a carrier has an active USDOT number and operating authority before we work with them, and we keep a record of that check. That's a real screen, and it's also a limited one. We do not vet their pay practices, their equipment, their dispatch, their safety culture, their home-time promises, or how they treat people.
We are not responsible for what a carrier does or says. That includes what they promise you, what they pay you, whether they hire you, how they screen you, how they contact you, and what they do with your information after we release it. Your dealings with a carrier are between you and them.
That said, we want to know. If a carrier we introduced you to lies to you, harasses you, or misuses your information, email contact@truckapply.com. We can and do cut off carriers.
12.Rules for using the site
Don't do any of these:
- Submit somebody else's information, or a phone number you don't control.
- Submit information you know to be false.
- Scrape, crawl, harvest, or bulk-download anything from the site, or use automation to submit the form.
- Try to get around a security measure, access an account or area that isn't yours, or probe our systems.
- Reverse engineer the site, or use it to build a competing product.
- Upload anything malicious, or anything unlawful, harassing, or infringing.
- Use the site to advertise, recruit, or solicit.
- Misrepresent yourself as affiliated with us.
We may suspend or block access, remove content, and pursue whatever remedies are available if you break these rules.
13.Our content and your content
The site, its design, text, graphics, logos, and the software behind it belong to us or our licensors and are protected by copyright, trademark, and other laws. “TruckApply” and our logo are our marks. You get a limited, revocable, non-exclusive, non-transferable license to use the site for its intended purpose. Nothing else is granted.
Anything you send us that isn't personal information about you — feedback, suggestions, ideas — you give us permission to use freely and without owing you anything.
14.Doing this electronically
You agree to do business with us electronically. That means:
- Clicking a button or checking a box that says you agree is your signature. It has the same effect as signing on paper.
- We may give you notices, disclosures, and records by email, by text, or by posting them on the site.
- Records we keep electronically satisfy any requirement that something be in writing.
To do this you need a device with a current browser, an internet connection, and either an email address or the ability to receive text messages. You can ask us for a paper copy of any record at no charge by emailing contact@truckapply.com, and you can withdraw your agreement to electronic records the same way. If you withdraw it, we may not be able to keep providing the service, since the service is a website.
Keep your contact information current with us. If your email or number changes, tell us at contact@truckapply.com.
15.Disclaimer of warranties
Some states don't allow all of these exclusions, so parts of this section may not apply to you.
16.Limitation of liability
Nothing in these terms limits your rights under laws that can't be waived, or limits our liability for our own fraud, willful misconduct, or gross negligence where the law does not permit that limitation. Some states don't allow these limits, so parts of this section may not apply to you.
17.Your responsibility to us
You agree to defend, indemnify, and hold us harmless from claims, losses, liabilities, and reasonable legal fees that come out of: information you gave us that was false or that wasn't yours to give; a phone number you gave us that you didn't control; your breach of these terms; or your unlawful use of the site. We'll tell you promptly about any such claim and let you control the defense, and you won't settle anything that admits fault on our behalf without our written consent.
18.Disputes, arbitration, and class action waiver
(a) Talk to us first. Before starting an arbitration or a lawsuit, you agree to send us a written Notice of Dispute at contact@truckapply.com or by mail, and to give us 60 days to work it out. The notice has to include your name, an address where we can reach you, the phone number or email you used with us, a description of the problem, and the specific relief you want. It must be personally signed by you. We'll send you the same kind of notice before we bring a claim against you. This step is a condition of starting a proceeding, and either of us can ask a court or arbitrator to enforce it. The clock on any deadline is paused while the 60 days runs.
(b) Small claims court is still open. Either of us can bring an individual claim in small claims court instead of arbitration, as long as it stays there and stays individual.
(c) Agreement to arbitrate. Except as stated in (b) and (g), you and we agree that any dispute, claim, or controversy arising out of or relating to these terms, the Privacy Policy, the site, the service, our communications with you, or the sharing of your information — whether based on contract, tort, statute, fraud, or any other theory, and whether it arose before or after these terms took effect — will be resolved by binding individual arbitration and not in court.
(d) How the arbitration works. The arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules, as modified by this section. A single neutral arbitrator decides it. The arbitrator can award the same individual relief a court could, including statutory damages and attorney's fees where a statute provides them, and must follow this agreement. The arbitrator's award is final and may be entered as a judgment in any court with jurisdiction. The Federal Arbitration Act governs this section.
(e) Where, and who pays. The arbitration will be held by telephone or video, or by written submissions, unless you ask for an in-person hearing — in which case it will be in the county where you live or another place we agree on. We will pay all filing, administrative, and arbitrator fees that exceed what it would have cost you to file the same claim in court, unless the arbitrator finds your claim was frivolous. Each of us otherwise pays our own attorney's fees, except where a statute or the arbitrator's award says otherwise.
Coordinated filings. If 25 or more people submit Notices of Dispute raising substantially similar claims, and they are represented by the same or coordinated counsel, all of those claims will be resolved in staged batches of no more than 50 at a time, with a single arbitrator per batch, and the deadlines in the AAA rules apply per batch rather than per claim. Neither side may seek to certify a class, but both sides may agree to a global resolution.
(g) Carve-outs. This section does not cover: an individual action in small claims court; a request for temporary or permanent injunctive relief to stop infringement or misuse of intellectual property; or any claim that applicable law says cannot be arbitrated or cannot be waived. If a court decides that a claim for public injunctive relief cannot be arbitrated, that claim alone will be paused and heard in court after the arbitration finishes.
(h) Your right to opt out. You can reject this arbitration agreement. Send us an email at contact@truckapply.com with the subject line “Arbitration Opt-Out,” including your name and the phone number or email you used with us, within 30 days after you first accept these terms. That's all it takes. Opting out has no effect on anything else in these terms and we will not treat you any differently for doing it. If you opt out, disputes go to court under section 19, and the class action waiver in (f) does not apply to you.
(i) If part of this fails. If the class action waiver in (f) is found unenforceable as to a particular claim, then this entire arbitration section does not apply to that claim, and that claim proceeds in court under section 19 — but the rest of this section still governs every other claim. If any other part of this section is found unenforceable, that part is severed and the rest stays in effect.
(j) Survival and changes. This section survives the end of your relationship with us. If we change this section, the change does not apply to any dispute for which a Notice of Dispute was already sent.
19.Governing law and venue
These terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws rules, except that the Federal Arbitration Act governs section 18. For any dispute not subject to arbitration, you and we agree to the exclusive jurisdiction of the state and federal courts located in Cook County, Illinois, and each of us consents to personal jurisdiction there.
This does not deprive you of the protection of any mandatory consumer-protection law of the state where you live. If a law of your home state gives you a right that can't be waived by contract, you keep it.
20.Changes to these terms
We can change these terms. When we do, we'll update the version and effective date at the top of this page and post the new version here.
If a change is material — meaning it meaningfully affects your rights, such as a change to section 18, or a change to how we share your information — we will give you at least 30 days' notice before it takes effect, by email or text if we have a way to reach you, and we'll say plainly what changed. Continuing to use the site after a material change takes effect means you accept it. If you don't accept it, stop using the site and ask us to delete your information.
Changes are not retroactive. The version in effect when something happened is the version that governs it, which is why we keep every prior version and can produce the exact text you agreed to.
21.Ending this
You can stop any time. Email contact@truckapply.com and ask us to delete your information, or use the privacy request form. We can suspend or end your access at any time, with or without reason.
Some things outlive the relationship: sections 9, 15, 16, 17, 18, 19, and 22 survive, and so do the records described in the Privacy Policy that we're required or permitted to keep — including your place on our do-not-call list and our proof of what you consented to.
22.Everything else
- Entire agreement. These terms and the Privacy Policy are the whole agreement between us about the service, and they replace anything said earlier.
- Severability. If a provision is unenforceable, it's modified to the minimum extent needed or severed, and the rest stays in force.
- No waiver. If we don't enforce something right away, we haven't given it up.
- Assignment. You can't assign these terms. We can, in connection with a merger, acquisition, or sale of assets — and if we do, your information moves under the same commitments, as described in the Privacy Policy.
- Force majeure. Neither of us is liable for a delay caused by something outside our reasonable control.
- No third-party beneficiaries. Carriers are not third-party beneficiaries of these terms.
- Headings. Section titles are for convenience and don't change the meaning.
